By accessing or using the HiFeelings mobile application or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility

You must be at least 13 years of age to use HiFeelings. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the Service.

3. Your Account

When you create an account, you agree to:

• Provide accurate and complete information.
• Maintain the security and confidentiality of your credentials.
• Promptly notify us of any unauthorised use of your account.
• Take responsibility for all activity that occurs under your account.

4. User Content

You retain ownership of any content you create on HiFeelings, including IFeel Cards, Letters, and Memories ("User Content"). By submitting User Content, you grant HiFeelings a limited, non-exclusive licence to store and process it solely to operate and improve the Service. You are solely responsible for your User Content and confirm it does not violate any applicable laws or third-party rights.

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful or harmful purpose.
• Harass, abuse, or harm other users or Listeners.
• Post content that is hateful, obscene, or violates any person's privacy.
• Attempt to gain unauthorised access to any part of the Service.
• Use automated tools, bots, or scrapers on the Service.
• Impersonate any person or entity.

6. Listener Programme

Listeners on HiFeelings are volunteers who agree to be kind, compassionate, and non-judgemental. HiFeelings is not a mental health service, and Listeners are not therapists or medical professionals. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services immediately.

7. Intellectual Property

The HiFeelings name, logo, design, and all related content are the exclusive property of HiFeelings and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. HiFeelings does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, HiFeelings shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, HiFeelings, or third parties. You may delete your account at any time through the app settings.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
